TERMS OF SERVICE
Severson Digital Marketing LLC dba Hey Ada
These Terms of Service ("Terms") govern your use of Hey Ada at heyada.app. By creating an account or using Hey Ada, you agree to these Terms.
1. What Hey Ada Does
Hey Ada is an AI-powered social media content creation tool for service businesses. You provide information about your business, and Hey Ada helps research, plan, generate, and format social media content and graphics for your review and use.
2. Your Responsibilities
You are responsible for:
- Reviewing AI-generated content before publishing or using it.
- Confirming that facts, claims, prices, services, credentials, reviews, and other information are accurate.
- Ensuring content you publish complies with applicable laws and the rules of the platforms where you publish it.
- Having the necessary rights and permissions for information, images, logos, reviews, and other materials you provide to Hey Ada.
You may not use Hey Ada to knowingly create or publish false claims, fabricated reviews or credentials, defamatory material, unlawful content, or content that infringes another person's rights.
3. AI-Generated Content
Hey Ada uses artificial intelligence. AI-generated content can contain mistakes, omissions, or inaccurate information.
Generated content is provided for your review and is not independently verified by Hey Ada unless we expressly state otherwise.
You are responsible for deciding whether generated content is appropriate to publish.
To the extent we have rights in content generated specifically for you, we assign those rights to you. We do not guarantee that AI-generated content is copyrightable, unique, or free from similarity to content generated for others.
4. Subscriptions and Billing
Hey Ada offers monthly subscription plans.
If you purchase a subscription:
- Your subscription renews automatically each month until cancelled.
- You authorize us and our payment processor to charge the applicable subscription fee and taxes to your payment method.
- You may cancel at any time.
- Unless otherwise stated at cancellation, you retain paid access through the end of your current billing period.
- Payments are generally non-refundable except where required by law or where we expressly agree otherwise.
- If payment fails, access may continue during our payment-retry/grace period and may be suspended or terminated if payment remains unsuccessful.
- Prices and plan features may change. Changes to an existing paid subscription will be communicated as required by applicable law.
5. Free Access
Hey Ada may provide a limited free experience before requiring a paid subscription.
No credit card is required for the current free experience.
Free usage may be limited by the number of topics, generated posts, or other features available. After the free allowance is used, you must purchase a subscription to continue using paid features.
We may modify or discontinue free offers for future users.
6. Cancellation and Data
If your subscription ends, your Hey Ada account and associated product data are scheduled for deletion after 30 days, unless you reactivate your subscription during that period.

7. Service Availability
We work to keep Hey Ada available and functioning properly, but we do not guarantee that the service will always be uninterrupted, error-free, or available.
We may modify, suspend, or discontinue features as the service evolves.
8. No Guarantee of Results
We do not guarantee:
- The accuracy or completeness of AI-generated content.
- That generated content will be unique.
- Specific engagement, followers, leads, rankings, sales, revenue, or other business results.
- That third-party platforms will accept, display, rank, or continue supporting content in any particular way.
9. Third-Party Services
Hey Ada relies on third-party services, including AI, payment, hosting, database, email, and social-platform services.
We are not responsible for outages, changes, restrictions, or actions of third-party services outside our reasonable control.
10. Limitation of Liability
To the fullest extent permitted by law, Severson Digital Marketing LLC and Hey Ada will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from your use of Hey Ada.
To the fullest extent permitted by law, our total liability for claims arising from or relating to Hey Ada will not exceed the amount you paid to Hey Ada during the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
11. Indemnification
You agree to indemnify and hold harmless Severson Digital Marketing LLC and Hey Ada from third-party claims, damages, or reasonable expenses arising from content or materials you provide or publish through your use of Hey Ada, your violation of these Terms, or your infringement of another person's rights.
12. Termination
We may suspend or terminate access to Hey Ada if you materially violate these Terms, misuse the service, fail to pay amounts due, or use the service unlawfully.
13. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
14. Changes
We may update these Terms from time to time. If changes are material, we will provide notice as required by law.
Your continued use of Hey Ada after updated Terms become effective constitutes acceptance of the updated Terms.
